The series of events are as follows
1 At 11.41 am on the 18th of December 2020 the RRSRA published the following Facebook post to its Facebook page.
2 At 3:17 pm on the 18th of December, the Acting President and Secretary of the RRSRA received the following email from City of Canning Councillor Amanda Spencer Teo.
3 At 4:25 PM Richard Aldridge as acting chairman of the association replied to Councillor Amanda Spencer Teo by email and copied in all committee members.
4 At 2:15 on the 20th of December Acting President Richard Aldridge called an emergency meeting of the RRSRA committee to discuss the matter and formulate a statement. The Meeting was set for 10 am on the 21st of December.
5 The meeting of the committee was held
The committee decided :
A to produce this post for publication on the website to provide members and interested parties complete transparency regarding the situation.
B to inform all members through email
C to post the following Facebook post to its Facebook page to clarify the situation with Facebook group followers with the following text and image.
D To write a letter from the committee and wait for further communication / apology from Councillor Amanda Spencer Teo.
E Release the following statement
RRSRA committee Statement:
The RRSRA post stated “The motion passed 9/2 with councilors Kunze and Spencer-Teo voting against the all abilities play area”.
This statement is fully evidenced by the City of Canning publication of the unconfirmed minutes for the Ordinary Council Meeting 8th December 2020. NOM-10-20 part 1 which reads:
The initial post is considered accurate and as such the RRSRA committee feels it is inappropriate to remove or amend the post or apologize for making the post.
For a publication to be defamatory it needs to be unsubstantiated by facts.
RRSRA accused of Defamation
The RRSRA has received an email from Amanda Spencer Teo a City of Canning Councillor threatening legal action for defamation regarding an RRSRA facebook post on the 18th of December. (Link to this pagel)
The RRSRA post concerns a council decision NOM-10-20 to approve an all abillities play area at Kent street weir.
RRSRA committee statement:
The RRSRA post stated, “The motion passed 9/2 with councilors Kunze and Spencer-Teo voting against the all abilities play area”.
This statement is factual and evidenced by the City of Canning publication of the unconfirmed minutes for the Ordinary Council Meeting 8th December 2020. NOM-10-20 part 1 which reads:
1) “Requests the Chief executive officer to establish an all abilities play areas at the Kent Street Weir precinct besides the standard play equipment, with equipment especially for people with disabilities.
For: Mayor hall, Deputy Mayor Jacobs, Crs Bain,Barry Holland, Ponnuthurai, Porter, Sabiri, Sweeney
Against: Crs Kunze,Spencer Teo
As the initial post is accurate the RRSRA feels it is highly inappropriate to remove or amend the post or apologise for making the post.
